TIPPAY – Terms & Conditions and Privacy Policy

Welcome to TIPPAY (“Tippay”, “we”, “us”, “our”). These Terms & Conditions and Privacy Policy (collectively, the “Agreement”) govern your access to and use of https://www.tippays.com (the “Site”) and all related products, services, applications, features, and tools (collectively, the “Service”).

By using the Service, you agree to this Agreement. If you do not agree, you must discontinue use immediately.

1. Definitions

  • “Guest” – a user who sends a tip and/or feedback to a Service Provider.
  • “Service Provider” – a worker who receives tips and/or feedback through the Service.
  • “User”, “you” – any individual or entity accessing or using the Service, including Guests and Service Providers.
  • “Tip” – voluntary payment sent by a Guest to a Service Provider through the Service.
  • “Account” – a registered profile enabling access to certain features.
  • “Third-Party Payment Processor” – payment services used by Tippay to process transactions.

2. Eligibility

To use the Service, you must:

  1. Be at least 18 years old (or legal age in your jurisdiction).
  1. Have legal authority to enter into agreements.
  1. Use accurate and truthful information.

If you use the Service for a company (e.g., a hotel), you confirm you are authorized to bind that entity.

3. Our Role

  1. Tippay is a digital tipping and feedback platform.
  1. Tippay is not an employer, agency, or intermediary between hotels, employers, Guests, or Service Providers.
  1. Tippay does not guarantee any minimum amount of tips or income.
  1. Tippay is not responsible for employment terms between users and their employers.

4. Accounts

  • You may be required to create an Account.
  • You are responsible for your credentials and activity under your Account.
  • You must notify us of any unauthorized access.
  • We may suspend or terminate accounts for violations or risks.

5. Tips and Payments

5.1 Voluntary Tips

Tips are optional and are not a replacement for wages, salaries, or employer obligations.

5.2 Processing

  • All payments are handled by Third-Party Payment Processors.
  • Tippay does not store full payment card numbers.

5.3 Fees

Tippay may charge platform or processing fees. These will always be presented before payment.

5.4 Payouts

  • Payouts to Service Providers are subject to processing times, verification, and legal requirements.
  • Settlement times are not guaranteed.

5.5 Refunds, Disputes, Chargebacks

  • Tips are generally non-refundable, unless required by law.
  • Tippay may offset disputed amounts from future payouts.
  • Tippay may, at its discretion, help resolve disputes but is not obligated to.

6. Taxes

Users are solely responsible for:

  • Reporting and paying taxes on tips;
  • Compliance with local tax regulations.

Tippay does not provide tax advice.

Where required, Tippay may report data to authorities or withhold amounts.

7. Acceptable Use

You agree not to:

  • Use the Service for illegal purposes (fraud, money laundering, terrorism).
  • Misrepresent your identity.
  • Interfere with the platform, servers, or security systems.
  • Upload harmful code.
  • Violate privacy, intellectual property, or any third-party rights.

We may investigate and respond with legal action where needed.

8. User Content (Feedback)

  • You may submit ratings, comments, or feedback.
  • You are responsible for your content.
  • You grant Tippay a global license to use such content to operate and improve the Service.
  • We may remove inappropriate content at our discretion.

9. Intellectual Property

  • The Service, branding, software, text, graphics, and all content are owned by Tippay or licensors.
  • You may not copy, modify, distribute, or create derivative works without permission.
  • You receive a limited, revocable license to use the Site for lawful purposes.

10. Privacy Policy – How We Handle Your Information

Tippay respects your privacy. This section explains what we collect and how we use it.

10.1 Information We Collect

A. Information You Provide

  • Account details (name, email, phone, employer info).
  • Tips sent/received and feedback.
  • Verification documents, if required.
  • Support messages.

B. Automatically Collected

  • IP address, browser, device type.
  • Usage data (pages viewed, clicks, session duration).
  • Cookies and tracking technologies.
  • Transaction metadata (amounts, currency, timestamps).

C. From Third Parties

  • Hotels/employers for employee verification.
  • Payment processors (transaction status).
  • Analytics providers.
  • Identity verification partners.

We do not buy data from brokers.

11. How We Use Your Information

We use your information to:

  1. Provide the Service and process transactions.
  1. Manage your Account.
  1. Prevent fraud and maintain security.
  1. Comply with regulations (AML/KYC/tax).
  1. Communicate with you.
  1. Improve and develop features.
  1. Enforce compliance with this Agreement.

We do not sell personal data.

12. Legal Bases (GDPR Users)

We rely on:

  • Contractual necessity (provide the tipping service).
  • Legal obligations (compliance).
  • Legitimate interests (security, fraud prevention).
  • Consent (cookies and optional marketing).

13. Sharing of Information

We may share your data with:

13.1 Payment Processors

To facilitate tip payments and settlements.

13.2 Hospitality Partners

If you are an employee using Tippay through your workplace.

We never share Guest contact info with hotels.

13.3 Service Providers

Cloud hosting, analytics, fraud detection, customer support.

13.4 Legal Authorities

Where required by law, regulation, or court order.

13.5 Business Transfers

If Tippay merges, is acquired, or sells assets, data may transfer under protection agreements.

We do not sell or rent personal information.

14. International Transfers

Your data may be stored or processed abroad. We use legal mechanisms such as:

  • Standard Contractual Clauses (SCCs),
  • Data Processing Agreements (DPAs),
  • Adequacy decisions.

15. Data Retention

We keep data for only as long as necessary for:

  • Service operation,
  • Legal compliance (including financial and AML regulations),
  • Dispute resolution.

Typical periods:

  • Transaction data: 7 years
  • Account data: until deleted
  • Support logs: 2 years
  • Cookies: per settings

16. Security

We implement reasonable administrative, technical, and organizational measures to protect your data, including encryption and access controls.

However, no system is perfectly secure. You use the Service at your own risk.

17. Your Rights

Depending on your location, you may have the following rights:

  • File a complaint with a regulatory authority

21. Limitation of Liability

To the maximum extent permitted by law:

  • Tippay shall not be liable for indirect, incidental, consequential, or punitive damages.
  • Tippay’s total aggregate liability shall not exceed: 1,000 USD.

Some jurisdictions restrict these limitations; in such cases, only the minimum required by law applies.

22. Indemnification

You agree to indemnify and hold harmless Tippay from any claims arising from:

  • Your use of the Service,
  • Your violation of this Agreement,
  • Your violation of any third-party rights,
  • Your submitted content.

23. Changes to This Agreement

We may update these terms or the privacy policy at any time. If changes are material, we may notify users via email or site notice. Continued use of the Service constitutes acceptance.

24. Termination

We may suspend or terminate your access at any time for violations or risks. Rights intended to survive termination will continue.

25. Governing Law & Jurisdiction

This Agreement is governed by the laws of: State of Israel

Courts located in: Tel Aviv, Israel have exclusive jurisdiction.
